2008 MyShot08™ Photo Contest Rules & Regulations

 

BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE TO BE BOUND BY THESE OFFICIAL RULES AND REGULATIONS AND THE DECISIONS OF XEROX CORPORATION ("XEROX”) AND WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THIS CONTEST OR THESE CONTEST RULES.

Qualified Entries


MyShot08™ welcomes entries of photography used in one of these three applications: photo books, greeting cards or calendars. Entries must fit into one of the following categories:

Entry Categories

1.   Photo Book This category includes photographs put together in a coffee table book format.
2.   Calendar This category includes photographs that will be incorporated into horizontal or vertical layout and will be designed according to pre-determined templates.
3.   Greeting Card This category includes photographs that will be incorporated into horizontal or vertical layout and will be designed according to pre-determined templates.

  • Overall “Best of Show” award:
    • (1) Day on Set with George Kamper (includes travel, food, hotel)
    • Fujifilm Infrared Camera
    • $500 Print Credit at H&H Color Lab
  • College of best in show winner will win:
    • $2,000 donation to college
    • Adobe® Software approximate retail value (“ARV”) not to exceed $1,800. 
    • Fujifilm S5 Camera
  • First place winners in each category three (3) awards:
    • $1,000 MasterCard Gift Card
    • Adobe® Software “ARV” not to exceed $1,200.
    • $250 Print Credit at H&H Color Lab
  • Second place winners in each category three (3) awards:
    • $500 MasterCard Gift Card
    •  Adobe® Software “ARV” not to exceed $700.
    • $250 Print Credit at H&H Color Lab
  • Third place winners in each category two (2) awards:
    • Adobe® Software “ARV” not to exceed $600.
    • $250 Print Credit at H&H Color Lab
  • Most Entries by college award:
    • $1,500 donation to college

    • $250 Print Credit at H&H Color Lab

The “Best of Show” award and the First, Second and Third place winners in each category will receive the prizes detailed above as their prize. The above prizes have no cash value and are not redeemable or refundable for cash. Awarding of the prizes will be subject to prevention or delay for any cause or event beyond Xerox’s reasonable control, including without limitation, war, civil disturbance, terrorist acts, acts of the public enemy, embargo, failure of subcontractors/vendors to perform, lockout, strike, other labor action, or acts of God. All prizes are valued in United States dollars. The approximate retail value of the “Best of Show” award is $6,500. “First place” winners in each category will receive the above prizes valued up to $2,450. “Second place” winners in each category will receive the above prizes valued up to $1,450. “Third place” winners in each category will receive the above prizes valued up to $850. “College best of show” winner will receive the above prizes valued up to $5,300. “Most entries by college” winner will receive the above prizes valued up to $2,950. “Most popular entry” winner will receive the above prizes valued up to $550. “First 25 Entrants” prize is valued up to $25/book or $625. All Adobe® Software is based on current retail value. Prize substitutions or cash equivalents are only allowed by Xerox in its sole discretion. Xerox also reserves the right to award a prize of equal or greater value if the advertised prize is unavailable. Winners may be required to verify ownership of their submission. Winners shall also be required to execute and return an Affidavit of Eligibility and Liability and/or a Publicity Release within 14 days of notification. Non-compliance with these conditions will result in disqualification and selection of an alternate winner. There are no substitutions with respect to the Awards given, except as determined by Xerox at its complete discretion.

Entry Submissions
Entrants may participate in this contest by registering online at www.myshot08.com and downloading the appropriate creative software to develop their entry.

Entries submitted by any other means, will not be eligible. Entries will be accepted for the three Entry Categories outlined above. Any proprietary information, such as but not limited to, any trademarks, copyrights, trade names or other private information submitted or contained in a submission (or on the media containing a submission) must be populated with fictional information. Incomplete submissions will not be considered for awards.

Electronic entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Entries will not be returned.

Entry Dates
Completed entries must be received by Xerox by midnight March 31, 2008 to be accepted. Late submissions are not eligible.

Multiple Entries
An entrant may submit one entry for each of the three categories outlined above as long as each entry is submitted with the appropriate documentation and electronic files required by these Rules and Regulations.  An entrant cannot submit the same application in more than one category.

Fees and Costs
NO FEE, PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN MyShot08™. A PURCHASE DOES NOT IMPROVE AN ENTRANT’S CHANCE OF WINNING. The entrant assumes all costs associated with preparation and submission of entry materials.

Judging
Winners will be selected by a team of distinguished professional photographers and print industry experts as appointed by contest sponsors. No telephone calls or correspondence will be accepted from contestants inquiring on winners or judges’ selections.

The judges will assess entries using the following criteria:

  • Degree of innovation
  • Use of photography in application
  • Overall aesthetics

Awards will be distributed on the sole authority and discretion of the judges. All judges’ decisions are final. Any entrant who fails to comply with all of these Rules and Regulations will be disqualified.

Disqualification
An entrant’s submission(s) will be disqualified, at the sole discretion of Xerox, if entrant attempts (a) to enter the contest through any means other than as described in these Rules and Regulations, or (b) to disrupt the contest, circumvent the terms and conditions of these Rules and Regulations, or in any way tamper with the contest, or (c) enters any photographic content that is deemed as unacceptable in nature, which will be at the discretion of Xerox. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest may be a violation of criminal and civil laws and should such an attempt be made, Xerox reserves the right to seek damages from any such person to the fullest extent permitted by law.

Copyright and Re-use Authorizations 
Submissions will not be returned. Entrants, upon submission of entry(s), will have secured and certified all necessary rights and licenses from all constituents and third parties including, but not limited to creative agencies and their clients, printing houses, photographers, illustrators, models, trademark holders, etc.  Acceptance of the "Best of Show" award and the first, second or third place awards in each of the three categories constitutes permission for Xerox and its designees to use the winner's name, likeness and submitted winning images for print samples bearing the MyShot logo for an 18 month period beginning May 15, 2008, without additional compensation unless otherwise prohibited by law. If chosen as a winner, entrant will provide written authorization and permission for Xerox to use the source files/photography in this regard.

Award Winner Announcement
Information about the winning entries will be shared with the public via a Xerox press release and posting to the Awards website www.myshot08.com the week of May 5, 2008. Additionally, each winner will be personally contacted either by telephone or email using the contact information provided by the entrant in their entry form.

Eligibility
This contest is open only to students enrolled in an accredited college. Participants must be 18 years of age or older at the time of entry who reside in and are physically located in the 50 United States and The District of Columbia (excluding Puerto Rico and all other territories). Employees of Xerox Corporation, its affiliates and subsidiaries, and their immediate family or household members are not eligible to enter.

General Conditions
This contest is VOID WHERE PROHIBITED BY LAW and invalid in any State that requires the registration or licensing of such matters, unless Xerox has registered the contest in such State. This contest and these Rules and Regulations shall be interpreted in accordance with the laws of the State of New York without regard to its conflict of laws principles. Each participant: (a) agrees that any legal suit, action or proceeding arising out of or relating to this Contest shall be instituted exclusively in New York; (b) waives any objection to the venue of any such suit, action or proceeding and the right to assert that such forum is not a convenient forum; and (c) irrevocably consents to the jurisdiction of the courts of New York in any such suit, action or proceeding.

All federal, state and local laws and regulations apply. By entering, participants release and hold harmless Xerox and its respective subsidiaries, affiliates, officers, directors, employees and agents from any damage or liability of any kind arising from or in connection with this contest, including but not limited to claims based upon the infringement of a third party’s intellectual property rights or claims based upon the enjoyment of the Awards.

All prize awards are subject to any applicable taxes and withholding. Taxes on the prize awards, if any, are the responsibility of the winner. Xerox is not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction of unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information on account of technical problems or traffic congestion on the Internet, at any website or any combination thereof. Xerox is not responsible for any injury or damage to entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the contest, or for mail-in entries that are lost, late, misdirected, damaged, incomplete, altered, illegible or postage-due. Xerox is not responsible for any visas, authorizations or other approvals required by the winners for enjoyment and use of the Awards. Entries will not be returned.  Xerox reserves the right to cancel temporarily or permanently the electronic method of entries if it becomes technically interrupted.

The sole purpose of this Awards program is to promote digital innovation. The Awards program does not constitute an offer or obligation to participants to buy any products or services from Xerox.

Addressing Concerns on Photo Usage

It has come to my attention that some members of the educational photography community have concerns about the MyShot08™ photo contest, specific to the topic of digital image rights. We’ve listened to the feedback and want to clarify certain points.
 
The purpose of this contest has always been to highlight up-and-coming photography talent by giving them a showcase to see their outstanding work in print.
 
We have no intent of using any images other than those taken by the winners of the "Best of Show” award and the first, second or third place awards in each of the three categories. Xerox is not interested in securing any usage rights in non-winning entries. Non-winning entrants will retain all the rights to their works.
 
We responded to suggestions from the photographic community shortly after the launch of the program to reduce the rights reuse period to 18 months. It was never Xerox’s intent to become owners of any of the photographic works.
 
Photographers will always be given credit when their image is used - including an email credit if they wish - in the hopes the credit can provide a boost to their careers.

We hope these clarifications help to ease concerns. We apologize for any confusion, and look forward to seeing more outstanding entries to build on the terrific work we’re already seeing.
